(PRLEAP.COM) Valdosta, GA. – In early March 2012, all of the original criminal charges against local builder/developer Jason Bailey were dismissed by the State Court of Lowndes County, with the exception of a citation for a window tint violation. Bailey retained famed DUI defense attorney William C. "Bubba" Head of Atlanta, along with the local Valdosta law firm of Coggins and Greneker, to fight the charges.Bailey was arrested on May 16, 2010 at a roadblock set up on Rocky Ford Road. He was initially indicted for felony drug possession charges, DUI, child endangerment and window tint violation after this roadblock arrest. In 2011, the felony drug charges were dismissed by the District Attorney and the misdemeanor DUI, endangerment and window tint charges were transferred from the Superior Court to the State Court of Lowndes County.
Bailey, one of Lowndes County's most successful real estate builder-developers, contested the charges from the very beginning of the prosecution. He asserted that any drugs found by police in his vehicle were lawfully prescribed to him after an ankle injury and were not possessed illegally. Furthermore, he disputed the DUI and related child endangerment claims.
The criminal charges against Bailey were challenged and contested at every phase of the pre-trial proceedings. Bailey's attorneys filed numerous motions seeking to have a court declare the roadblock unconstitutional and to exclude other key evidence in the case. The motions were set to be heard on March 7, 2012.
When the motions were called for the hearing, the case was resolved through a negotiated settlement that dropped the DUI and child endangerment charges against Mr. Bailey. This action exonerated Bailey from the last of the serious charges that he had challenged since May of 2010. "I am happy to have been able to be vindicated, and to clear my good name," Bailey said.
