CONSUMER FINANCIAL SERVICES LAW REPORT PUBLISHES ARTICLE ON THE FACT ACT BY DR. LINDA EAGLE OF THE EDCOMM GROUP

Consumer Financial Services Law Report, a bi-weekly publication focusing on significant case law and emerging trends in banking, has published “The FACT ACT Remains A Gain For Consumers, A Potential Liability For Businesses,” an article by Dr. Linda Eagle, President of The Edcomm Group. The article highlights the provisions of the FACT Act pertaining to identity theft, the benefits the Act offers to consumers, and the responsibility of businesses, as well as recent court rulings.

In her article, Dr. Eagle outlines the privileges that the FACT Act offers consumers, and discusses possible legal precedents. According to Dr. Eagle, “Up to now the judiciary has generally rejected victims’ tort claims against businesses accused of enabling identity thieves. However, given the increased incidence of occurrence of identity-theft-related crime, the tide could change.”

Businesses also have a greater responsibility in relation to identify theft. Notes Dr. Eagle, “Financial institutions are subject to more procedural requirements thanks to the FACT Act. They must now adopt procedures that will detect fraud and identity theft before it occurs or recognize ‘red flags.’ These red flags may be a suspicious change of address request, a request for a duplicate debit or credit card, or the reactivation of a dormant card. Businesses are also required to ensure that they adopt reasonable standards for the secure storage and disposal of all business records containing sensitive consumer information.”
