Talcum Powder Lawsuit Investigation Launched by Bernstein Liebhard LLP Amid Concerns That Talc-Based Products May Contribute to Ovarian Cancer

March 01, 2016 (PRLEAP.COM) Business News
March 1, 2016 - Bernstein Liebhard LLP is investigating talcum powder lawsuits (http://www.rxinjuryhelp.com/talcum-powder/lawsuit/) on behalf of women who allegedly developed ovarian cancer due to years of regular, repeated use of talc-based products for feminine hygiene purposes. The Firm's investigation is being launched amid growing concern that long-term use of talcum powder in this manner may increase the risk that a woman will develop this devastating and potentially deadly disease.

Court documents indicate that Johnson & Johnson is now facing some 1,200 ovarian cancer lawsuits involving its Baby Powder and Shower to Shower products. On February 22nd, a St. Louis, Missouri jury awarded $72 million to the family of a woman who blamed her death from ovarian cancer on those talc-based products. The verdict marked the first time that a jury ordered Johnson & Johnson to pay financial damages in a talcum powder lawsuit. "Talcum powder products, such as Johnson's Baby Powder and Shower to Shower, are ubiquitous in millions of American homes. The possibility that long-term, genital exposure to talc could contribute to the development of ovarian cancer is an important public health issue that warrants attention," says Sandy A. Liebhard, a partner at Bernstein Liebhard LLP, a nationwide law firm representing victims of defective medical devices, drugs and consumer products. The Firm is offering free legal reviews to women who were diagnosed with ovarian cancer following years of regular, repeated use of talc-based products for feminine hygiene purposes.

Talcum Powder Litigation
The woman at the center of the Missouri lawsuit had regularly used Johnson & Johnson's talcum powder products for over 30 years as part of her feminine hygiene routine. She died this past fall, just 2 ½ years after being diagnosed with ovarian cancer. The jury deliberated for just under five hours before awarding her family $10 million in compensatory damages, along with $62 million in punitive damages.

In November 2015, the New Jersey Supreme Court created a multicounty litigation for talcum powder lawsuits filed against Johnson & Johnson, and centralized more than 100 cases involving the company's talc based products in Atlantic County Superior Court. Plaintiffs allege that Johnson & Johnson has placed profits before consumer safety by withholding information and warnings regarding the association between talcum powder and ovarian cancer from the public. The lawsuits assert that studies have suggested talcum powder may migrate through the vagina and into the fallopian tubes, uterus and ovaries when applied to the genital area. Some of the complaints also allege that evidence of talc has been found in the ovarian tumors of the women named in the lawsuits. (In Re: Talc-Based Powder Products, Case No. 300)

While the St. Louis verdict marked the first time talcum powder plaintiffs were awarded financial damages in a case involving Johnson & Johnson, it was not the first time that a jury concluded the company's talc-based products contributed to the development of ovarian cancer. In October 2013, a South Dakota federal jury also found that Johnson & Johnson had failed to provide consumers with adequate warnings about the risk of ovarian cancer from talcum powder. However, the jury declined to award any damages to the plaintiff in that case. (U.S. District Court, District of South Dakota, Southern Division, Case No. 4:09-cv-04179-KES)

Women who were diagnosed with ovarian cancer following the long-term use of a talc-based products for feminine hygiene purposes may be eligible to file their own talcum powder lawsuit.
