MoloLamken Releases 2017 Supreme Court Business Briefing

This is the seventh year the firm has published its summary of the decisions from the U.S. Supreme Court's past Term that have the greatest relevance to business.

"The Supreme Court spent much of the Term shorthanded, as Congress did not confirm Justice Gorsuch to the late Justice Scalia's seat until the Court had already conducted six of its seven sittings," noted MoloLamken partner Robert Kry. "Given the resulting uncertainty, the Court took an incremental approach and generally issued narrow decisions," Kry said. "Despite that trend, the Court still issued a number of opinions with important consequences for businesses and investors," added Michael Pattillo, another firm partner.

The Court addressed many significant issues this Term. It clarified the scope of insider-trading liability, rejecting a narrower standard adopted by the U.S. Court of Appeals for the Second Circuit. It decided two patent cases that will have profound impacts-one that affects how patentees can limit the post-sale uses of their inventions, and another that changes the rules regarding where patentees can sue for infringement. It decided a pair of cases concerning class action litigation, in one case limiting the ability of plaintiffs to take immediate appeals from adverse class certification rulings, and in the other refusing to allow extensions of certain time limits for securities class action opt-outs. The Court also reaffirmed its commitment to enforcing arbitration agreements according to their terms.
