The .IN ccTLD Registry has announced an open Registration policy on October 28th. Pursuant to this policy, registrations of .in Domains are now opened up in a two phase Regisration process.

Following is a brief as to what you would require for booking a .in domain :

Phase I] Sunrise period - Starting Jan 1st to Jan 21st

In order to protect intellectual property rights of genuine trademark holders, Owners of registered Indian trademarks or service marks who wish to protect their marks will be given the opportunity to apply for .IN domain names before the general public between January 1 to January 21, 2005. This period is known as the sunrise period.

Individuals and Companies located anywhere in the world may apply for a .in domain name during this period as long as they have a Registered Indian Trademark or Servicemark.

If you are a company with a REGISTERED INDIAN TRADEMARK, now is the time for you to ensure that your intellectual property is protected adequately in the .in TLD. After 21st January, anyone will be able to register any .in domain name and you will lose out on the opportunity. Please follow the steps below to register your sunrise domain name


Step 1: Make sure you have a valid sunrise application

In order to be considered valid, a Sunrise application must meet all of the following criteria:

1. The trademark or service mark registration must have been issued by the Registrar of Trademarks, Government of India

2. The trademark or service mark registration must be current (non-expired) and valid, and must have been issued in the applicant's name prior to December 31, 2004.

3. The domain name applied for must be identical to the textual or word elements of the trademark or service mark that is registered

3a. The domain name applied for must be represented in ASCII characters only. Only letters, digits, and hyphens will be accepted in a domain name. No applications for domain names in internationalized script (including diacritical marks) shall be accepted.

3b. Spaces or punctuation that appear in trademark registrations can either be represented in the domain name by a hyphen, or can be disregarded. Similarly, ampersands (&) in the trademark can be disregarded, represented by a hyphen, or represented by the letters "and' (or the equivalent term in the language of the trademark registration, subject to 3a above).

For eg. If your trademark is "Sun-Kiss" you may apply for "sunkiss.in", "sun-kiss.in", "sunkiss.co.in" etc. You MAY NOT apply for "sun.in" or "kiss.in"

4. The applicant must submit proof of its trademark or service mark to the Registry for verification, as per the proof of trademark guidelines.

5. Make sure that your domain name is not present in the list of reserved names. This list may be downloaded at : www.spidercreation.com/reserved-names.pdf

6. Applications must conform to general Registry registration policies. For example, domain names shorter than 3 characters or longer than 63 characters are not accepted, nor are domain names that begin or end with hyphens.

7. Only letters, digits, and hyphens will be accepted in a domain name. No applications for domain names in internationalized script (including diacritical marks) shall be accepted.


Step 2: Fill in the application form and send in the documents and payment.

After filling the form send the following documents to the address below

1. A legible photocopy of the trademark certificate attested to be a true copy by a notary, magistrate, oath commissioner, gazetted officer, or other party authorized by the competent authority.

The above documents must reach us before 25 January 2005. Any documents received after that time will be ignored, and applications without documentation will be considered failed.


Step 3: Allocation of the domain names

The Registry will announce the allocation of names through the publication of the WHOIS, shortly before open registration begins for the general public on 16 February. The Registry will allocate the names by inspecting the application and the attached documents in the following manner -

1. If the application is found to be valid and there is only one application for that domain name it will be allotted to the applicant.

2. Where there are two or more applications for the same domain name, priority will be assigned in
the following order.

* Applications made by Indian companies and individuals will be given priority over those of foreign companies/individuals

* If two or more applications are received from Indian companies/individuals then the first valid application will be awarded the domain name


Phase II] Open Registration period - Starting Feb 16th

On 16th Feb 2005 the Registry will begin accepting real time registration applications from any individual anywhere in the world for any .in domain name. We will announce the process for submitting your pre-applications shortly.
