AASP Says Yes to Email Archiving Litigation Support Solutions

The 2006 amendments apply to any organization—commercial or nonprofit—that has the potential to be involved in litigation through the U.S. Federal Court System. This basically includes every business in the US. They require that companies be prepared for electronic discovery requests by knowing where their electronic message data is stored and ensuring that an effective method is in place for retrieving it. Many state and local court systems are simply mirroring these procedures and interpreting discovery terms locally.

What most archiving providers don’t promote revolves heavily around the search-discovery process itself. Many email archiving vendors exist. Almost all archive vendors claim to store, index, and compress electronic email and attachments. That is the marketing scam… “Better storage, creates better email server performance, help manage mailbox usage, easier for end users, saves time and money on recovering email instead of from backup tape”… the real story is all archiving vendors do that.

What is mission critical to archiving solutions… the ability to Boolean, text, date, and drill down on exact e-document content and attachments with search-discovery tools that save time, money, and stand up in court as originals. The most under marketed ediscovery element is the ability to differentiate between “Sue” (who works in the front office) and “sue” (I’m going to take these guys to court) in all your email, IM, and email attachment searches.

When AASP began researching the archiving solutions space, one software was dominating the most regulated of industries (securities & banks), the CA Message Manager formerly the iLumin/Assentor software. We found out why… the Natural Language Processing Engine is the mission critical element saving unbelievable amounts of time and money during the ediscovery process for litigation support. In addition to the language differentiation, searches are savable for duplication, results are exportable to commonly use file extensions, and the search results can simply be printed out. Getting the “least-best” amount of information to Legal departments condenses and conserves on litigation expenses in all legal support efforts. With some of the solutions we looked at, getting your archived information out of the system in a common format (migration to another archiving solution for example…) was not available because of a proprietary storage format.
