New Vaginal Mesh Multidistrict Litigation Established for Coloplast Lawsuits

(New York, NY, August 29, 2012) The Rottenstein Law Group, which represents clients with claims stemming from injuries allegedly caused by vaginal mesh devices, is alerting the public to the establishment of a new multidistrict litigation (MDL) for lawsuits filed against Coloplast Corp., a manufacturer of vaginal mesh devices.

On August 6, 2012, the U.S. Judicial Panel on Multidistrict Litigation created a federal multidistrict litigation (MDL No. 2387) for pelvic mesh devices made by Coloplast Corp. By a transfer order dated that same day, the panel centralized the cases that make up this MDL in the U.S. District Court for the Southern District of West Virginia, where according to an August 6, 2012 order in MDL No. 2004, the Honorable Joseph R. Goodwin will oversee the pretrial proceedings of MDL No. 2387, and of the MDLs pending against every vaginal mesh manufacturer other than Mentor.

The newly formed MDL No. 2387 is the sixth active multidistrict litigation for vaginal mesh devices, according to the Coloplast MDL transfer order and the August 6, 2012 order in MDL No. 2004. The other five vaginal mesh MDLs concern injuries allegedly sustained by patients as a result of vaginal mesh devices manufactured and sold by C.R. Bard, Inc. (MDL No. 2187); American Medical Systems, Inc. (MDL No. 2187); Boston Scientific Corp. (MDL No. 2326); the Johnson & Johnson subsidiary Ethicon, Inc. (MDL No. 2327); and Mentor Corp. (MDL No. 2004), which is pending in the U.S. District Court for the Middle District of Georgia, where it was centralized back in December 2008.

Coloplast has 24 federal actions filed against it, according to the August 6, 2012 Coloplast MDL transfer order. Nine of those 24 cases were already pending in the Southern District of West Virginia in one of the other four vaginal mesh MDLs, before the U.S. Judicial Panel on Multidistrict Litigation created the Coloplast MDL, the Coloplast MDL transfer order states.
