Federal AndroGel Lawsuit Trials Discussed During MDL Status Conference, Bernstein Liebhard LLP Reports

August 17, 2015 - The federal court overseeing thousands of testosterone treatment lawsuits (http://www.testosteronelawsuithub.com/) convened its most recent Status Conference on August 14th, at which time competing proposals for the selection of AndroGel bellwether cases were reviewed. According to documents filed in the U.S. District Court, Northern District of Illinois, defendant AbbVie, Inc. has proposed that the Court select 32 AndroGel lawsuits for case specific discovery. Once discovery was completed, the parties would choose six lawsuits from that initial pool for trial. However, plaintiffs maintain that only the final six trial selections should be left up to Court, and have proposed that each side submit initial lists of 16 potential bellwether candidates. Federal Testosterone Litigation
Court records indicate that more than 2,200 testosterone lawsuits have been filed in the Northern District of Illinois on behalf of men who allegedly suffered heart attacks and other cardiovascular events due to their use of AndroGel, Testim, Axiron and other prescription low-T medications. The litigation involving testosterone replacement therapy has been growing since January 2014, when the U.S. Food & Drug Administration (FDA) launched a safety review of the entire drug class. On March 3, 2015, the FDA ordered the manufacturers of prescription low-T treatments to update their labels with information regarding a potential association with an increased risk of heart attack and stroke. The agency also directed that the labels clearly state that the drugs have not been proven safe and effective for treating low testosterone related to male aging.

According to court documents, federal AndroGel lawsuits could begin going to trial next year. Bellwether trials involving other low-T treatments would likely begin sometime in 2017.
