3M Bair Hugger Lawsuit Centralization to Be Addressed at JPML's December Hearing Session, Bernstein Liebhard LLP Reports

October 22, 2015 (PRLEAP.COM) Business News
October 22, 2015 - The proposed centralization of all federally-filed 3M Bair Hugger lawsuits (http://www.3mbairhuggerlawsuit.com/) will be addressed on December 3rd, when the U.S. Judicial Panel on Multidistrict Litigation (JPML) convenes its next Hearing Session in New Orleans, Louisiana. According to an Order issued by the Panel on October 21st, the session will commence at 9:30 a.m. at the Hale Boggs Federal Building, U.S. Court House. (In Re: Bair Hugger Forced Air Warming Products Liability Litigation MDL No. 2666)

"Our Firm has received inquiries from numerous hip and knee replacement patients who allegedly developed serious post-operative infections due to the Bair Hugger forced air warming blanket. We are monitoring these oral arguments closely, and look forward to the JPML's forthcoming decision," says Sandy A. Liebhard, a partner at Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm is offering free, no-obligation Bair Hugger lawsuit reviews to patients who allegedly developed serious post-operative infections related to use of this forced air warming system.

3M Bair Hugger Litigation
The 3M Bair Hugger is a forced air warming blanket used during surgical procedures to regulate a patient's body temperature. According to court documents, there are currently more than 50,000 Bair Hugger warming systems in the nation's hospitals, and the apparatus has been used to warm millions of patients. However, Bair Hugger lawsuit plaintiffs claim that the forced air warming blanket suffers from a design defect that results in disruption of laminar flow in the operating room, allowing bacteria and other contaminants from the floor to enter the surgical site, thus increasing the risk that hip and knee implant patients will develop serious post-operative joint infections. Plaintiffs further claim that the 3M Company and its Arizant Healthcare, Inc. subsidiary have been aware of this risk for years, yet failed to make design changes or issue any warnings to the medical community.

Court records indicate that at least 14 hip and knee replacement lawsuits have been filed in U.S. courts on behalf of individuals who allegedly developed serious deep joint infections due to the Bair Hugger forced air warming blanket. In August, one of these plaintiffs filed a motion with the JPML seeking to have all such federal claims consolidated in the U.S. District Court, District of Minnesota, in order to reduce duplicative discovery, avoid conflicting pretrial rulings, and serve the convenience of the parties, witnesses and the courts. However, 3M and Arizant have filed a response with the JPML indicating that they are opposed to centralization.

Individuals who developed a serious deep joint infection following hip or knee replacement surgery that involved the use of this forced air warming blanket may be entitled to file their own 3M Bair Hugger lawsuit.
