Testosterone Lawsuits Move Forward, As Federal Court Sets Dates for First AndroGel Bellwether Trials, Bernstein Liebhard LLP Reports

According to an Order dated December 10, 2015, up to a dozen AndroGel cases will be selected for the litigation's first bellwether trials, which will be convened on the following dates: April 21, 2017; June 5, 2017; July 10, 2017; August 21, 2017; September 25, 2017; and November 6, 2017. The cases selected for trial will be chosen from a list of 32 AndroGel lawsuits previously chosen by the parties. Discovery in those cases will be completed by March 23, 2016. By June 7, 2016, plaintiffs and the defense are to submit their proposals for the final bellwether selections. The Court will then designate up to 12 lawsuits to serve as bellwether trial cases by June 24, 2016.

Court documents indicate that nearly 3,500 testosterone lawsuits are now pending in the Northern District of Illinois against the manufacturers of AndroGel, Axiron, Testim and Androderm. All of the complaints were filed on behalf of men who allegedly suffered life-threatening or deadly heart attacks, strokes, deep vein thrombosis or pulmonary embolism due to their use of testosterone replacement medications. Plaintiffs claim that testosterone manufacturers concealed these risks and failed to provide doctors and patients with adequate warnings regarding the serious cardiovascular side effects associated with low-T therapy. They also accuse the drug makers of wrongly promoting their products as safe and effective treatments for men who experienced diminished testosterone levels merely as a result of the normal aging process, even though the medications were never approved for this purpose.
The litigation involving AndroGel and other low-T therapies began to grow shortly after the U.S. Food & Drug Administration (FDA) announced in January 2014 that it was reviewing the cardiovascular risks potentially associated with the use of testosterone replacement drugs. On March 3, 2015, the FDA ordered the manufacturers of prescription low-T therapies to update their labels with information regarding a potential association with an increased risk of heart attack and stroke. The FDA also directed that the labels clearly state that the drugs have not been proven safe and effective for treating low testosterone related to male aging.
