Talcum Powder Lawsuits Continue, As Johnson & Johnson Seeks Dismissal of Certain Ovarian Cancer Claims, Bernstein Liebhard LLP Reports

June 2, 2016 - Hundreds of talcum powder lawsuits (http://www.rxinjuryhelp.com/talcum-powder/lawsuit/) that accuse Johnson & Johnson of failing to warn women about the alleged association between its talc-based powders and ovarian cancer continue to move forward in courts around the U.S. According to a Motion filed in the California Superior Court for Los Angeles County on May 25th, the Company is seeking the dismissal of an ovarian cancer case recently filed by the husband of a woman who died from the disease in 2012. Johnson & Johnson asserts that the claim lacks personal jurisdiction, and that the plaintiff has failed to establish that the decedent was a resident of California, ever purchased or used Johnson & Johnson's talc-based powders in the state, or developed or was diagnosed with ovarian cancer in California. According to court documents filed on May 20th in the U.S. District Court, Eastern District of Missouri, Johnson & Johnson has removed a multi-party talcum powder lawsuit involving 80 individual plaintiffs to federal court. The Removal Notice also disclosed that a motion has been filed in state court that seeks to dismiss the 77 non-Missouri plaintiffs named in the complaint for lack of personal jurisdiction. Millions of women have long incorporated talcum powder products into their daily feminine hygiene routine. But a number of studies conducted since the early 1970s have suggested that the regular and repeated application of talc-based powders to the genitals may contribute to the development of ovarian cancer. Just this past December, research published in the journal Epidemiology reported that women who routinely applied talcum powder to their genitals, underwear, sanitary napkins and tampons had a 33 percent higher risk of ovarian cancer. The study compared 2,041 women with ovarian cancer and 2,100 similar women who did not have the disease, all of whom were surveyed about their talcum powder use.

Court documents indicate that Johnson & Johnson is a defendant in more than 1,200 talcum powder ovarian cancer lawsuits that are now pending in courts around the country. Last month, a jury in St. Louis, Missouri, awarded $55 million in compensatory and punitive damages to an ovarian cancer victim who used Johnson & Johnson's Baby Powder and other talc-based powders for nearly 40 years as part of her feminine hygiene routine. In February, another St. Louis jury awarded $72 million in compensatory and punitive damages to the family of a woman who died from ovarian cancer. Prior to her diagnosis, the decedent had regularly applied Baby Powder and Shower-to-Shower to the genital area for more than three decades. (Case No. 1422-CC09012-01)
