Talcum Powder Lawsuit Trial Scheduled for February 6, 2017 in Missouri, Bernstein Liebhard LLP Reports

According to an Order issued on June 20th in the Missouri Circuit Court for St. Louis City, a trial scheduled to begin on February 21, 2016 will instead begin two weeks earlier, on February 6th. The case involves six plaintiffs who claim that their regular, repeated use of Johnson & Johnson's talc-based powders contributed to the development of ovarian cancer. (No. 1522-CC10417)

Court documents indicate that Johnson & Johnson is a defendant in more than 1,200 talcum powder ovarian cancer lawsuits that are now pending in courts around the country. In addition to the Missouri cases, nearly 200 claims have been centralized in a multicounty litigation now underway in New Jersey's Atlantic County Superior Court. Plaintiffs allege that as early as the 1970s, studies have suggested that the regular and repeated use of talc-based powders for feminine hygiene purposes increased a woman's risk of ovarian cancer. They further assert that Johnson & Johnson has been aware of this association for years, but placed profits before consumer safety by withholding information and warnings from the public. In April, a jury in St. Louis, Missouri, awarded $55 million in compensatory and punitive damages to an ovarian cancer victim who used Johnson & Johnson's talc-based powders for nearly 40 years as part of her feminine hygiene routine. In February, another St. Louis jury ordered the company to pay a total of $72 million to the family of a woman who died from ovarian cancer. According to that lawsuit, Baby Powder and Shower-to-Shower had been a regular part of the Decedent's daily feminine hygiene routine for more than 30 years. (Case No. 1422-CC09012-01)
