MoloLamken Releases 2022 Supreme Court Business Briefing
July 05, 2022 (PRLEAP.COM) Business News(Washington, D.C., July 5, 2022) – The national litigation boutique MoloLamken LLP is pleased to announce the release of this year's MoloLamken Supreme Court Business Briefing. This is the twelfth year the firm has published its summary of the decisions from the U.S. Supreme Court's past Term that have the greatest relevance to business.
"The Supreme Court delivered a number of landmark rulings on highly charged social issues this Term," noted MoloLamken partner Robert Kry. "While the Court's high-profile decisions this year will provoke no shortage of commentary, the Court's business docket was comparatively light," added Michael Pattillo, another firm partner.
An unusually large portion of the Court's business docket involved arbitration. The Court held that a statute authorizing U.S. discovery in aid of foreign or international proceedings does not apply to private arbitrations, shutting down a popular tool parties had used to gather evidence for international arbitrations. The Court also broadly interpreted an exemption from arbitration requirements for certain transportation workers, and it clarified the scope of federal court jurisdiction over petitions to confirm or vacate domestic arbitration awards.
The Supreme Court also addressed a number of other significant issues affecting business this Term. In one case, the Court held that the Occupational Safety and Health Administration lacked authority to impose a COVID-19 vaccine mandate, a decision that will complicate future agency efforts to combat the pandemic. In another, the Court issued a major environmental ruling under the Clean Air Act, paring back the Environmental Protection Agency's power to demand high-level changes to how States structure their power generation resources. The Court also imposed new limits on remedies for discrimination by recipients of federal funding, holding that plaintiffs may not recover damages for emotional distress.
The MoloLamken Supreme Court Business Briefing has been widely praised in both the business and legal communities for its clarity and insight. To read this year's edition, please click here. If you wish to receive a paper copy, please email Mike or Robert.
