Military Trial Attorney Interviewed by Chronicle of Higher Education

Keith Scherer of the military law firm Gagne, Scherer & Langemo, LLC, was recently interviewed by a reporter for The Chronicle of Higher Education. The interview focused on how the Army is set to handle the massive recall of members of the Individual Ready Reserve (IRR).

“We are going to see a surge in deployments,” said attorney Keith Scherer, “and in order to handle their deployment goals the military is going to rely heavily on recalling people who have already served and separated from the service.”

In the interview, Scherer explained how these new deployments could place some soldiers in quite a predicament. “Many people who receive recall orders will want to challenge the validity of the order,” said Scherer. “Others will refuse to comply with the orders. The military may try to declare that these people are AWOL or deserters, and have them arrested. The issue of whether the military has jurisdiction over people in the IRR can be complicated. Anyone who wants to challenge a recall order needs to consult with an experienced military attorney before taking any action. If they simply refuse to report, they could very well end up in jail.”
